Court lifts ban on selling Samsung Pay-enabled smartphones in Russia

The Arbitration Court of Appeal lifted the bar for Samsung and its Russian subsidiary to sell 61 models of Samsung Pay-enabled smartphones in Russia.

According to RBC, Samsung reports that the claim of Sqwin SA against it was declined in full.

“We are fully satisfied with the appellate decision and the fact that Samsung's arguments were carefully considered and accepted,” said Natalia Gulyaeva, managing partner of the Moscow office of Hogan Lovells, representing Samsung.

Last summer, Switzerland-based Sqwin SA filed a lawsuit, demanding to ban the operation of the Samsung Pay payment service and all smartphones on which it is used in Russia. The court banned the sale of smartphones, but the ruling was later cancelled by a higher authority.

Sqwin SA believes that their patented technology was used in Samsung Pay. The patent was registered in Russia in April 2019. In November 2021, Samsung filed an application with Rospatent to revoke the Sqwin SA patent for the invention “Electronic Payment System” due to registration violations.
